Sentencing Consulting Services

Joanne Hepworth, Reita Pendry and Cynthia Katkish have developed expertise in trying the most difficult criminal cases. Together they bring more than thirty years of experience from the diverse perspectives of private solo practice and the public defender service. Each has developed expertise in drafting successful pretrial motions, choosing juries, developing trial strategies, crafting persuasive arguments on legal issues and to juries, and in helping juries and judges to see clients in the most humanizing light.

Hepworth, Pendry and Katkish offer to colleagues at every level of practice a wealth of trial experience that will assist the litigator to gather and analyze evidence, draft winning pleadings, fashion a workable trial strategy, and employ that strategy to persuade the court to favorable rulings on legal issues and persuade juries to favorable factual resolutions. We can help you turn your problem case into one that gives your client the best chance for a favorable resolution.

The area of sentencing in federal and local criminal cases has undergone drastic changes in the past twenty years. With the advent of the mandated guidelines and mandatory minimum sentence legislation came an era of strictly conscribed rules of procedure which required extensive knowledge and expertise to navigate successfully. Both partners have had great success in obtaining departures and alternative sentences for our clients through these years. Since the Supreme Court's decisions in Apprendi and Booker, the rules of sentencing procedure have loosened and offer more opportunity for creative alternative arguments than before.

Hepworth, Pendry and Katkish know that extensive knowledge, preparation and effort at this stage makes all the difference for clients. We have many years of experience in working with and around the United States Sentencing Guidelines. We partner our advocacy skills with the expertise of treating professionals to address our clients' needs and to fashion resolutions which provide treatment opportunities in lieu of or in addition to incarceration. We have particular expertise in working with clients who suffer mental health impairments and addiction to drugs or alcohol.

We work from the therapeutic and restorative justice models, in an effort to provide judges with sentence options that offer meaningful opportunities for clients to heal and be restored to their communities, even in those cases where some period of incarceration is inevitable.
